Former Michael Jackson Hairstylist Testifies About His Painkiller Use

A hair stylist and makeup artist who worked for 27 years with Michael Jackson testified today that she told a drug therapist after the pop star’s “Dangerous” tour in the early 1990s that she worried that his use of pain killers could be fatal.

Taking the stand for the second day on behalf of the plaintiffs in the trial of the negligence and wrongful death lawsuit that Jackson’s mother brought against entertainment giant AEG Live, Karen Faye said under cross- examination by defense attorney Marvin Putnam that Jackson went into a rehab program in England that was recommended by Elizabeth Taylor.

“I said I was afraid Michael could die,” Faye said in recalling different stages of the “Dangerous” tour. “Personally, there were times when he was OK and times when I was worried.” Faye said on Thursday that Jackson stumbled in his dressing room during a stop in Singapore on the “Dangerous” tour. She said he was taking medication after surgery for scalp reduction to try and remove a bald spot left over from burns he received when special effects went awry in the 1984 filming of a Pepsi commercial. Faye also testified on Thursday that Debbie Rowe, then the nurse for Jackson dermatologist Dr. Arnold Klein, was present during the “Dangerous” tour with a bag of medications. Jackson would later marry and divorce Rowe. The couple had two children. In other testimony today, Faye said she expressed her drug abuse concerns about Jackson’s health with his oldest sister, Rebbie Jackson, after the woman reached out to her requesting information about the singer. Faye said she could not recall the time period when the conversation occurred.

She said she also had more abbreviated discussions about the same topic with another two of the singer’s other siblings, LaToya Jackson and Randy Jackson.

Faye said that in later years Jackson’s family members unsuccessfully tried to get him to return to rehab.

“I never knew them to be successful, sir,” Faye told Putnam. “I’m sure they were trying to help him in any way the could.”

Faye said she did not discuss Jackson’s drug problem with him personally.

“I just avoided that issue like the plague, sir, the molestation and the drug areas,” she told Putnam today.
Asked by Putnam if Jackson ever sought drugs from her, Faye replied affirmatively.

“He asked me one time if I had pain killers,” Faye said. “I said no, I didn’t.”

Faye said she also became concerned during Jackson’s 2005 trial and acquittal on molestation charges that he was using drugs again, saying she based her assumptions on his appearance and his demeanor. She said she got up early every morning to get Jackson ready for court.

She said Jackson told her he had extreme back pain, in large part because of a 1999 concert accident in Munich when a bridge prop on which he was standing unexpectedly descended into the orchestra pit. She said he was hospitalized for part of the molestation trial because of the back pain that likely dated from the Munich accident.

She said she decided again to avoid confronting Jackson about possible drug abuse.

“It was my job and my duty as a friend to make that time … calm and peaceful,” Faye said. “I didn’t want to confront him with anything. No matter what he was doing, I could never blame him for that because of the pain.”

AEG Live attorneys maintain that Jackson hired Dr. Conrad Murray in 2006 as his personal physician and chose him to be his doctor during his “This Is It Tour.” Jackson was rehearsing for 50 sold-out tour dates in London at the time of his death on June 25, 2009 at age 50.

Lawyers for 82-year-old Katherine Jackson, who filed the lawsuit in 2010 on behalf of herself and her son’s children, allege that AEG Live hired Murray and failed to supervise him properly.

Murray was convicted in 2011 of involuntary manslaughter for giving the singer the anesthetic propofol as a sleep aid and was sentenced to four years in jail.

Tragic Michael Jackson was so frail in the days before his death he could not sing and dance at the same time, documents allege.

And it is claimed his physical state so worried bosses of his comeback tour that they made contingency plans to use backing tracks at his £100-a-ticket shows.

But The King of Pop died aged 50 from an overdose of powerful anaesthetic shortly before the This Is It shows were was due to start at London’s O2 Arena in July 2009.

Jackson’s mother Katherine, together with his three children, are suing concert promoters AEG Live for £31billion.

A string of emails, seen by the Mirror and to be presented to the Los Angeles Superior Court in California, make it clear there were serious fears about Jacko’s ability to perform.

Long-term Jackson family friend Terry Harvey claims the singer had laid down vocals over several months to work as back-up material for shows.

And the promoter insists he made Jackson’s managers Dr Tohme Tohme, Frank DiLeo and contract lawyer Dennis Hawk aware of his dangerously frail state.

He says he warned Di Leo, who died in 2011: “You are going to kill Michael.”

In other evidence it is claimed Jacko was so emaciated that, two days before he died, his heart could be seen beating.

Make-up artist Karen Faye said costume director Michael Bush looked in horror at Jackson’s unclothed body before a dress rehearsal: “He said, ‘Oh my God ... I could see Michael’s heart beat through the skin of his chest’.”

Faye, 60, who worked for Jackson over nearly three decades, claimed he was on the brink of death weeks before his drug overdose.

She wept, describing how she made up Jackson in his coffin, but refused to “help retouch” footage of the singer for the posthumous documentary, “This Is It”.

Faye blasted: “It was a lie. I didn’t want a lie.

“Everybody was lying after he died, (saying) Michael was well. Everybody knew he wasn’t. I felt retouching Michael was just a part of that lie.”

The key emails show there was a difference between the public version of Jackson’s rehearsals and reality.

After announcing the series of This Is It gigs, ticket sales reaped more than £169million at the box office.

But on June 16, 2009 music arranger Michael Bearden revealed the singer was unable to sing live and dance, just three weeks away from the start at London’s 02 Arena.

In a message entitled Plan B, Bearden told Kenny Ortega, producer and director of the This Is It tour, that he planned using Jackson’s studio material.

Bearden wrote: “If we can’t get everything we need from the vault I can use what we have and take out ad libs and such to try to make it feel new.

“MJ is not in shape enough yet to sing this stuff live and dance at the same time. He can use the ballads to sing live and get his stamina back ... I have full confidence he can sing the majority of the show live.

“His voice sounds amazing right now he just needs to build it back up.”

Dancer Travis Payne, who let slip Jackson needed golf carts to get around the arena, responded with, “Great idea”.

There were even rumours, strongly denied, that a Jackson stand-in was used to announce the London gigs.

Harvey, claims the singer recorded show vocals weeks before his rehearsals.

He said: “On This Is It there were moments where he wasn’t singing, his energy levels were down and anyone who worked with him in the past could tell Michael was a way off from 100 per cent. We found out Michael was in the studio recording tracks for the show and even new albums in his last months. You can put your voice in a sequencer and backing track for live shows, so if you don’t want to sing you mime and fans don’t realise.”

Other documents show how, five days before Jackson’s death, Ortega asked AEG managing director Randy Phillips to pull the plug.

On June 20 Ortega wrote: “My concern is that now that we’ve brought the doctor in to the fold ... the artist may be unable to rise to the occasion due to real emotional stuff.”

He continued saying how Jackson was “trembling, rambling and obsessing,” adding: “Everything in me says he should be psychologically evaluated. If we have any chance at all to get him back.”
Ortega added: “He’s terribly frightened it’s all going to go away. He was like a lost boy.” But Phillips shot down Ortega, after consulting Dr Conrad Murray.

Phillips refused to consider stopping the This Is It concerts. “You cannot imagine the harm and ramifications of stopping the show now,” he said.

“I am not just talking about AEG’s interests here, but the myriad of stuff and lawsuits swirling around MJ that I crisis manage, and also his well-being.” Signing off as Randy he added: “It’s time to put out the fire, not burn the building.”

Harvey and partners AllGood Entertainment offered Jackson a Dallas 2009 comeback show, on the provision he went to rehab. But the singer chose AEG’s gigs in London.

It prompted a lawsuit with AllGood which they lost in 2010. But today Harvey claims AllGood plan to refile their £200million lawsuit against AEG for stealing the Thriller star from their grasp.

Harvey claims he spoke to Jackson in his last few weeks over the deal with AllGood.

He said: “It was part of the contract for Michael to get clean. His mother Katherine and father Joe knew that, and we made it clear to everyone close to him.

“For months we told Michael’s lawyer at the time Dennis Hawk, his managers Frank DiLeo and Dr Tohme Tohme he needed rehab.

“I told Frank, ‘He needs to get clean first’, but he didn’t want to know. It was an open secret in close circles that Michael had addiction issues.”

Harvey claims Jackson had agreed to do a one-off return gig in Dallas but was lured away by AEG execs.

Harvey, 53, who lives in Oklahoma, said: “Michael’s comeback was tailor-made for one show. He didn’t need to slug it out for 50 nights. The This Is It sales figures prove our formula – they made $200million from a rehearsal, so we would have made more – and Michael would have taken the lion’s share.

“There is a feeling that Michael’s death turned about to be a good business decision for AEG. It hurts me to say that, because people forget Michael was not just a commodity, but a troubled human being, with a lot still to offer, who was dedicated to his three kids. The only reason he did this was so that his kids could see him perform.”

AllGood, who have worked with stars such as Bon Jovi and Stevie Wonder, are set to refile their £200million law suit in the next few weeks.

“We feel there is a strong case,” said Harvey. “The company were not given access to the emails that have come up in this case.
“We have depositions from senior AEG executives, who insisted that Michael was healthy enough to do ‘100 shows’ in the days before the rehearsals. The emails in the Jackson case suggest they had knowledge of problems. People knew Michael had a long term drug condition.

“His employees saw him unable to walk after visiting doctors – it was even on the news, but no one stepped in. I think AEG will lose to Katherine Jackson.”

The Jackson family claim that as Jackson’s personal physician Dr Conrad Murray was responsible for administering the fatal anaesthetic, AEG should be held responsible as they were his employer. AEG deny responsibility.

Choreographer, Stacy Walker testified on Monday for AEG Live, saying that she saw no signs of any problems with Michael’s health other than that he appeared thinner. She was the first witness called by AEG. She worked on Michael’s planned comeback concerts, and during her testimony today, said that she didn’t see any signs that he was ill or might die in the final days of his life.

Ms Walker, who is testifying for AEG, said Michael appeared thinner than he had been in previous years and wore multiple layers of clothes while rehearing for his ‘This Is It’ shows, planned for London’s O2 arena. She said despite Michael missing multiple rehearsals, she was convinced based on his performances the last two days of his life, that he was ready for the series of shows.

Previous witnesses have testified that he was shivering and appeared unprepared. Ms Walker said she never saw any of that behavior, although she acknowledged that her job was to work with other dancers and not Michael directly.

“I wasn’t looking for things at the time,” she said. “I wish I was.”

Ms Walker also stated that she was frustrated by the fact that Michael had missed some rehearsals, but said, that her concerns were swept away during the last two preparation sessions for his anticipated ‘This Is It’ comeback concerts, in London.

“I finally saw what I was looking to see,” said Stacy Walker.

Walker said she was so encouraged she told her mother to buy a ticket for opening night in London. “I was very excited and relieved and hopeful,” she testified.

Boyle didn’t elaborate on the written exchange in court, but a source told the Daily News that Katherine’s lawyers plans to show email evidence of the alleged request later during the civil trial.

The source confirmed Katherine’s side has not recovered any video footage showing Michael in a compromised physical condition.

The jurors likely will decide whether any such video ever existed and, if it did, whether executives conspired to hide it.

“Mr. Jackson told me he wanted to sing all the songs live,” Payne said. “He had not always done that in the past.”

“By June 25, he had not reached the goal of being able to do both (dancing and live signing),” Payne said.

Negligence Is Debated in Jackson Death Case

LOS ANGELES — After only two weeks of testimony, no side has a clear advantage in the civil trial pitting the mother of Michael Jackson against A.E.G. Live, the promoter of his attempted comeback concerts, over the question of who was responsible for Jackson’s death.

But both sides have chosen the same weapons: Jackson himself, his problems with drugs and the wrenching details of his last days. What’s most surprising is that even with so much written and revealed about Jackson since his death four years ago, there is still more to learn.

Martin S. Putnam, A.E.G.’s lead lawyer, promised in his opening statement that the case would reveal “ugly stuff” about Jackson’s private life. And witnesses called by lawyers for Jackson’s 83-year-old mother, Katherine, have testified at length about Jackson’s addiction to medications, his physical deterioration and his belief that he was talking to God.

The case hinges on the fairly limited questions of whether A.E.G. hired Dr. Conrad Murray, the physician who administered the powerful anesthetic that killed Jackson in June 2009, and if it was negligent in doing so. Dr. Murray was convicted of involuntary manslaughter in a separate criminal trial in 2011, and is serving a four-year prison sentence.

Lawyers for Mrs. Jackson have said that they may seek up to $5 billion in damages. But the greater risk for both A.E.G. and the Jackson family is the potential damage to their reputations as the details of Jackson’s life and final days are revealed, in perhaps even greater detail than at Dr. Murray’s criminal trial.

“It’s all downside for A.E.G.,” said Bill Werde, the editorial director of Billboard magazine. “And this trial affects A.E.G., as well as the touring and broader music industry. Every time people see headlines about these incredibly sad details of Michael Jackson’s life, it makes this seem to be an uncaring business that exploits stars, even to their peril.”

Witnesses last week included two women who had worked for Jackson for decades, both describing him as a sensitive artistic genius haunted by physical pain. One, Karen Faye, his makeup artist since the early 1980s, said that Jackson became more dependent on prescription drugs over the course of his career.

The other woman, the choreographer Alif Sankey, tearfully recounted how, less than a week before Jackson died, she had begged Kenny Ortega, the director of “This Is It,” Jackson’s attempted comeback concerts, to take him to the hospital after Jackson appeared ill and said that God was speaking to him.

“I had a very strong feeling that Michael was dying,” Ms. Sankey said. As she testified, the only other sound audible in the small courtroom was the tapping of journalists on their laptops.

On Monday another choreographer on “This Is It,” Stacy Walker, who was called by lawyers for A.E.G., testified that she saw no signs that Jackson was in bad shape before he died.

“I just never in a million years thought he would leave us, or pass away,” Ms. Walker said, according to a report by The Associated Press.

The evidence in the case has included e-mails from A.E.G. executives which the Jackson lawyers say show that the company was acting as Dr. Murray’s employer. One message, sent to Mr. Ortega less than two weeks before Jackson’s death, says of Dr. Murray: “We want to remind him that it is A.E.G., not M. J., who is paying his salary. We want to remind him what is expected of him.”

A.E.G., a global sports and entertainment company controlled by the billionaire Philip F. Anschutz, denies that it hired Dr. Murray, saying that he had been selected by Jackson and that his $150,000-a-month salary was to come out of Jackson’s earnings for the tour.

What damage the case could cost Jackson’s reputation — and his valuable estate — is unclear. The estate has flourished, even though his faults and indiscretions have already been widely publicized, and entertainment and estate experts say that the details revealed in this trial are likely to elicit more sympathy for Jackson, not less.
“I don’t think this will negatively impact Jackson’s earning potential through music or consumer product licensing at all,” said Martin Cribbs, who has represented the estates of Einstein and Gandhi. “What truly separates a legend from just a star is when their body of work supersedes who they were as an individual.”

In a court filing last May, the estate said that it had had gross earnings of $475 million since Jackson’s death.

Jackson got more headlines last week when a choreographer, Wade Robson, said that Jackson had sexually abused him as a child. Lawyers for the Jackson estate — which is not a party to the A.E.G. case — immediately excoriated Mr. Robson’s claims as “outrageous and pathetic,” and Mr. Putnam told reporters that the claims were irrelevant to the current Jackson civil suit.

Also this week, a California state attorney filed a response to an appeal by Dr. Murray, whose lawyers have argued that the judge in the case made legal errors in not sequestering the jury and not allowing jurors to hear evidence about Jackson’s troubled finances. In the filing on Monday, Supervising Deputy Attorney General Victoria B. Wilson wrote that there were no errors, and that Dr. Murray’s lawyers had forfeited opportunities to object to the judge’s rulings, according to The A.P.

By the standards of Los Angeles celebrity trials, the Jackson suit seems a quiet affair. The judge, Yvette M. Palazuelos, has barred cameras, and the 45 seats in the courtroom are occupied mostly by lawyers and reporters. A daily lottery for the two or three seats guaranteed for the public draws the same small circle of Jackson superfans. There was one notable guest: Judge Lance A. Ito, who presided over O. J. Simpson’s murder trial in 1995, sat briefly in the gallery last week.

But the trial, which is expected to last at least three months, will draw more attention as potential witnesses include stars like Diana Ross and Quincy Jones, who may testify to Jackson’s professional drive or his physical condition.

LOS ANGELES – Michael Jackson appeared "a little loopy" after visits with his longtime dermatologist and was considering using a teleprompter to help him perform some of his songs during his ill-fated comeback concerts, a choreographer who worked one-on-one with the pop superstar told a jury Tuesday.

Travis Payne said he expressed concerns to the director of the "This Is It" shows that Jackson might be misusing prescription medications and was exhibiting troubling signs of insomnia, weight loss and paranoia in his final days.

Some of the behavior occurred after Jackson's visits with dermatologist Dr. Arnold Klein, who Payne believed was performing cosmetic treatments on the singer so he would be comfortable performing onstage again.

"Sometimes in rehearsal, Michael would appear just a little loopy," Payne said, adding that the singer appeared to be "assisted or under the influence of something."

Jackson's condition and missed rehearsals led to talk within the last 10 days of Jackson's life that AEG Live LLC, which was promoting "This Is It," might cancel the concert series.

Payne was working for AEG and said he relayed his concerns about Jackson's possible prescription drug use to tour director Kenny Ortega. Jackson was struggling to get into shape for the shows, and Payne said his voice coach suggested using a voice track for fast-paced songs until the singer's stamina improved.

He said Jackson wanted to use a teleprompter during the shows as "extra security," but it was an aid the performer had not used in his two previous tours.

The choreographer testified for AEG, which is being sued by Jackson's mother. Katherine Jackson claims AEG failed to properly investigate Conrad Murray, the doctor who was convicted of involuntary manslaughter for Jackson's death, and that the concert promoter also missed or ignored signs of Jackson's poor health.

Payne's testimony was similar to two plaintiff's witnesses, dancer Alif Sankey and makeup artist Karen Faye, who testified last week that Jackson was in poor health and paranoid in the weeks before his death and they alerted Ortega about it.

AEG Live considered "pulling the plug" on Michael Jackson's comeback concerts 11 days before the pop icon died, the show's choreographer testified Tuesday.
Travis Payne, who worked closely with Michael Jackson in his final days, earlier testified that in Jackson's last rehearsals before his death, he was "not at show standards but he was rehearsing, he was processing."

Payne was called as a witness by AEG Live to counter Jackson witnesses who testified in the ongoing wrongful death trial that Michael Jackson was emaciated, paranoid and so ill they feared for his life as rehearsals continued until shortly before his death on June 25, 2009.

The trial, in which Jackson's mother and three children contend AEG Live is liable in his death, is in its third week in a Los Angeles courtroom. The lawsuit accuses the concert promoter of negligently hiring Dr. Conrad Murray, the physician who was convicted of involuntary manslaughter in Jackson's death.

The Jacksons contend AEG Live executives ignored warning signs, including Jackson's weight loss, because they did not want to delay the premiere of the "This Is It" concerts set for July 2009.

'Pulling the plug' on comeback

"It was 'We've got to get this together or the plug may be pulled,' " Payne testified under cross examination by a Jackson lawyer Tuesday.

Jackson was having trouble learning some of his dances in the final weeks, he said.

The jury saw an e-mail from show director Kenny Ortega saying Jackson had "been slow at grabbing hold of the work."

He also asked that a teleprompter be placed near the stage to help him remember song lyrics, something Jackson had never used before during a concert, he said.

An e-mail written by "This Is It" band director Michael Bearden to Ortega 11 days before Jackson's death was displayed in court.

"MJ is not in shape enough yet to sing this stuff live and dance at the same time," Bearden wrote. "He can use the ballads to sing live and get his stamina back up, Once he's healthy enough and have more strength I have full confidence he can sing the majority of the show live. His voice sounds amazing right now, he needs to build it back up. I still need all big dance numbers to be in the system so we can concentrate on choreography."

But Ortega sent Jackson sent home without performing at the next rehearsal three days later because he was ill.

Medical records showed Jackson visited his Beverly Hills dermatologist nearly two dozen times in the two months before his death, receiving injections of the powerful painkiller Demerol.

"Sometimes he was tired and lethargic and had to be, not convinced, but supported throughout rehearsals," Payne said.

Payne, though, said Jackson's rehearsals the last two nights were "impressive" when he "was able to do chunks of the show."

"He was not at show standards, but he was rehearsing, he was processing," he said. "I didn't expect him to be as if he was in front of a crowd. The last two days were pretty good."

Was he ready to perform for an audience? Panish asked.

"I thought he was on his way to the goals he had set for himself," Payne answered. "All I saw was improvement and getting closer to the goals."

One of those goals was for Jackson to be able to sing all of his songs, while dancing, without the aid of pre-recorded tracks, Payne testified Monday. Jackson had relied on recorded vocal tracks in previous tours, but he didn't want to use them in London, he said.
Payne was often inside Jackson's home rehearsing with him during his final weeks. He got an intimate view of what he called "the beauty" of Jackson's relationship with his three children.

Payne saw "their loyalty to their father" and their father "enlightened them and taught them," he testified. "I was very proud to see Michael as such a loving father."

His description of the close relationship Paris, 15, and Prince, 16, had with their father four years ago could foreshadow the significance of the children's testimony later in the trial.

Paris, who was 11 at the time, was "a very retentive young lady who was very, very smart, very astute," Payne testified.

"She had full knowledge of the day-to-day operations, from the time of lunch and what it was going to be, she was hands on -- far beyond her age," he said. "She had a lot of responsibility, which I think she welcomed.

Payne said she was "the female of the house" and "a daddy's girl."

Lawsuit examines employer liability

But the key question under examination in the civil lawsuit Katherine Jackson v. AEG Live L.L.C. is whether the buck should stop there.

Westport attorney and medical malpractice specialist Michael Koskoff and three of his colleagues are in Los Angeles as members of the Jackson family’s legal team, which is claiming that tour producer AEG hired Murray and that as his employer, it should be held liable for the singer’s premature death.

While the outcome of the case could have billion-dollar implications for both parties, Koskoff — senior partner at Koskoff Koskoff & Bieder P.C. — said many of the legal arguments in the case could just as easily be applied elsewhere.

“I think in general the lesson that an employer has to take out of this is that they do have to exercise reasonable care in hiring an independent contractor when they’re doing it on behalf of a third party,” Koskoff said. “When they are selecting an independent contractor for a third party and paying an independent contractor for a third party, they can be liable to the third party for damages that are caused.”

In Jackson v. AEG, some of the pivotal questions are whether Murray — who had treated Jackson prior to his preparations for the 2009 AEG tour — was actually hired by AEG, whether he was strictly an agent, servant or employee of AEG, and whether AEG was negligent in its supervision of Murray.

Just as a bus company would be held responsible for an accident caused by one of its drivers, “the law is that an employer is responsible for all agents, servants and employees who are directly answerable to that employer,” Koskoff said.

But this particular case is slightly different, he said, because Murray was hired as a doctor “and doctors by their very nature are not essentially agents of the employers but they are independent contractors.”

Jackson family lawyers say they may seek up to $5 billion in damages. The trial, which began with opening statements April 29, is expected to last two to three months.

Lawyers for AEG, a global entertainment company, have said Murray was chosen by the singer himself and that Murray’s $150,000-a-month salary was to come directly out of Jackson’s earnings for the tour.

Evidence that has been introduced over the course of the trial throws that assertion into question, Koskoff said, pointing to an email sent from an AEG executive to tour director Kenny Ortega just weeks before Jackson’s death. The email, referring to Murray, said, “We want to remind him that it is A.E.G., not M. J., who is paying his salary. We want to remind him what is expected of him.”

Koskoff said the plaintiffs are trying to prove that Michael Jackson had a drug addiction, that the tour promoters knew about it, and that they should have been on notice that “this guy (Conrad) is someone to be concerned about, that this is someone who is feeding that addition rather than actually acting as an independent doctor.”

He said similar criteria could apply to a general contractor working on a home or a building. “If you hire a general contractor to work on your house and the general contractor hires an electrician who has no credentials and your house burns down because of improper wiring, the general contractor could well be responsible for that if they hadn’t exercised reasonable care in the selection of the electrician.”

A Pennsylvania attorney for the widow of manager Frank DiLeo said Thursday that he would turn over emails that could be relevant to the case, which accuses entertainment behemoth AEG of responsibility for the pop singer’s death in 2009.

The attorney, David Regoli, who spoke via telephone in a downtown Los Angeles courtroom, said he had made a copy of DiLeo’s email inbox while he was doing work for the manager’s estate. DiLeo died in 2011.

Attorneys for Jackson’s mother and three children said they have a court order for those emails and believe they could include exchanges between DiLeo and AEG executives. Their wrongful death suit alleges that AEG hired and controlled Dr. Conrad Murray, who administered a fatal dose of the anesthetic propofol to the singer as he was preparing for a series of comeback concerts.

Regoli estimated that the digital file was about two gigabytes in size and he said he would make a log of the emails that would be pertinent to the trial. He is expected to give both the plaintiffs and the defense an update of his progress next week.

DiLeo, who died in 2011, was brought up last week in dramatic testimony given by Jackson’s hair and makeup artist.

Karen Faye said that during Jackson’s final days she tried to warn DiLeo about the singer’s health.

“Frank was saying pretty much, ‘I got it under control, don’t worry about it,’ ” Faye testified Friday.

“I said, ‘But he’s losing weight rapidly.’ … I said, ‘Why don’t you ask [costume designer] Michael Bush to verify taking in his pants and how much weight he’s actually losing?’ ”

Faye said DiLeo went to speak to Bush and she overheard the manager say, “Get him a bucket of chicken.”

“It was such a cold response,” she said. “I mean, it broke my heart.”

Jackson died soon afterward. Murray is now serving jail time for involuntary manslaughter.

An AEG finance executive Thursday verified a 2009 company budget that allotted $300,000 to be paid to Dr. Conrad Murray for two months of caring for Michael Jackson.

Julie Hollander, vice president/controller of event operations for AEG Live, testified in the wrongful death trial that Murray’s salary of $150,000 each for the months of May and June that year was included in a budget approved by executive Paul Gongaware.

Gongaware is one of the defendants in the civil suit filed against the entertainment company by Jackson’s mother and three children who allege that AEG hired and controlled Murray. Murray treated Jackson as he was preparing for "This Is It,” a series of comeback concerts to be held in London, and gave the singer a fatal dose of propofol.

The case, which could be worth millions, or even billions to Jackson’s family, could turn on whether the jury believes Murray took his marching orders from Murray or Jackson himself.

Hollander was responsible for overseeing the books and the general ledger of all transactions related to “This Is It,” but said it was AEG executive Timm Woolley who actually created and managed the budget and made sure people got paid.

Woolley advised her that Murray was “engaged at the request of the artist,” Hollander said, and added that the budgets were ultimately approved by Gongaware.

Hollander called the doctor’s contract with AEG a “draft” because, although it was signed by Murray, neither Jackson nor AEG had signed it.

“If Michael Jackson didn’t die and AEG signed, then AEG would owe the money, right?” Brian Panish, the Jackson family’s attorney, asked.

“If all parties signed it would have been a fully executed contract, yes, and I would have to — if the costs were approved — it would be no basis for me to say I’m not going to pay that,” Hollander said.

She said, however, that there were situations where contracts were signed after Jackson’s death because “due to the abrupt end of the tour, deals were renegotiated.”

Hollander verified a document created May 16, 2009, that listed dozens of changes to the “This Is It” budget. Murray was listed as item 29.

“MJ wishes to have a permanent physician available on call throughout the pre-tour period on operational period,” the document said. “There are 2 months at $150,000 newly budgeted.”

Hollander said she spoke with Woolley about the inclusion of Murray on the budget and to AEG’s in-house attorney Shawn Trell about conditions under which the doctor would be paid.

On May 18, 2009, Hollander wrote an email to several executives asking for information that would help give AEG owner Philip Anschutz an idea of the upcoming tour profits.

“We are in the process of quickly pulling together an urgent re-forecast for Mr. Anschutz and need the latest and greatest on MJ,” her email read. “I recall that you were working on an update. Is it ready for consumption? I need something by tomorrow at the latest.… Once the numbers are in, I need direction from you with respect to the split between UK and US.”

Panish asked Hollander, “They weren’t asking you how the rehearsals were going, were they?”

“No.”

“They wanted to know how much money would be made for the U.S. and how much money would be made for the U.K., correct?”

Julie Hollander, an AEG Live vice president in charge of budget review for the “This is It” tour, was called by Jackson family attorneys Thursday to answer the pivotal question.

She testified that Dr. Murray’s $150,000 a month salary was budgeted into the tour. But she also testified that the independent contractor agreement signed by Dr. Murray was only a draft contract since Jackson or AEG reps didn’t have a chance to sign it before he died.

Jackson family lawyers argued that Murray successfully negotiated the agreement with AEG Live and that he had performed his duties for several weeks — making it an oral contract and a legally binding one.

AEG’s side argues that Dr. Murray was chosen by Jackson and that no written contract was ever completed or signed to state otherwise.

Before convincing a jury that AEG was negligent in hiring Dr. Murray, Jackson family attorneys must first convince the jury that the doctor was working for AEG Live before the company can be held responsible for hiring and supervising him.

Michael Jackson trial: Conrad Murray's payment demands 'outrageous'

A professional concert tour director testified Friday in the Michael Jackson wrongful death trial that a doctor's demand for $5 million to serve as the singer's tour physician "raised a red flag."


Marty Hom, who has spent 25 to 30 years as a tour director and tour manager, said that Dr. Conrad Murray's original demand was "outrageous." Murray, a cardiologist who closed his practice to serve Jackson, eventually agreed to work for $150,000 a month.

Brian Panish, one of the family's lawyers, said he played the testimony to ensure the jury heard it, even if AEG did not call Hom during the trial.

Hom also testified he had never been on a tour where the artist brought a doctor along, although he later said doctors toured with the Rolling Stones and Blink 182, but Hom did not work with them.

Much of Hom's testimony centered on the relationship between a tour manager, performer and doctor. A key question in the lawsuit is whether Murray, who was in desperate financial straits, was more concerned with Jackson's interests or AEG's.

Hom said it was not appropriate for the tour manager or promoter to inject themselves into the doctor-patient relationship.

Asked if it would be OK for someone to speak to the performer's doctor without the artist present, he answered, "I thought it was the doctor's responsibility to say no."

He said he knew of no instance where a promoter or producer had a private conversation with the artist's doctor.

He testified that when performers were ill, "my natural instinct is to go to that doctor and ask him, 'Is that dancer going or musician going to be able to make that show in a week?”

Hom also testified that he knew of no instance where a promoter or tour manager paid the performer's manager.

Panish said outside court that he will later introduce evidence that AEG was paying Jackson's managers, which could be a conflict of interest.
