Jurors challenged in Michael Jackson case

The extensive connections of Michael Jackson, his family and friends have been a challenge for a US judge trying to select an impartial jury for his mother's wrongful death lawsuit against the company that promoted Jackson's ill-fated This is It concert.

As individual questioning finally began on Monday, some jury prospects who had passed the written portion of the process had to be excused because of personal connections.

Among them was David Walsh, a Canadian singer-songwriter who said he had met members of the musical Jackson family and was friends with Lisa Marie Presley, Jackson's ex-wife. He said his own manager was on the witness list.

"I've had friends in Michael's band and my best friend was a backup singer on the This is It concert," Walsh said.

Walsh said he had formed opinions about the case that were probably unshakeable.

Katherine Jackson's suit claims AEG endangered Jackson's life by hiring an incompetent doctor, Conrad Murray, to look after the superstar singer.

AEG lawyers are expected to argue that Jackson was complicit in his own demise by insisting on hiring Murray and demanding the anaesthetic propofol to help him sleep.

The latest phase of jury selection came after jurors filled out questionnaires about their views on Jackson, his family and his life and death.

A preliminary group of 104 prospects was immediately reduced by six when members reported hardships or acquaintances on the witness list.

By day's end, 17 prospects had been excused, most because the extended length of the trial would cause them financial hardship. The case is expected to last for months.

More panellists sent notes to Superior Court Judge Yvette Palazuelos before court recessed for the day, asking to be excused.

One member of the jury pool said he had met Dr Conrad Murray at a barbecue sometime after Jackson's death and they had a social conversation. But he said he didn't realise who Murray was, and once he did he stopped talking to him. He remained on the panel.

Murray is serving a prison term after being convicted of involuntary manslaughter in Jackson's death from an overdose of propofol. Jackson died in his bed in June 2009 at the age of 50.

Complicating the case is the fact that neither Jackson nor AEG had signed Murray's $US150,000 ($A146,092)-a-month contract. Jackson died before Murray was paid.

A slurring Michael Jackson made a frantic call to an aide of Dr. Arnold Klein just seven weeks before his death in a desperate attempt to reach a doctor.

This previously unheard voicemail, obtained exclusively by RadarOnline.com, shows the Thriller singer couldn’t properly utter a short sentence on May 3, 2009 at around 11:06 a.m.

Jackson — sounding almost unrecognizable from his voice of a generation — begged Jason Pfeiffer, who worked for the singer’s Beverly Hills, Calif. dermatologist Dr. Klein, to call him back.
It’s Michael. Err, I can’t find Klein,” said Jackson, who later died on June 25 at the age of 50.

“Um, I have a problem in the groin area, and I don’t want to say this on the phone… inflamed area there, um, on a private… I don’t want to say this on the phone. Get him to call me please.”

After a brief pause, the legendary King of Pop murmured: “Thank you. Right away. Bye bye.”
RadarOnline.com can reveal Pfeiffer has met with lawyers for AEG and is prepared to testify in support of the concert promoter which is preparing to defend itself against the Jackson family, who has filed a $40 billion wrongful death suit.

“Michael Jackson had a death wish,” Pfeiffer, 39, told us, in an exclusive interview.

“I don’t think any one person and certainly not anyone at AEG could stop that.

“No-one realized he was getting drugs from all these different places, and it was inevitable something was going to go wrong.

“I have deep sympathy of his children and family, but Michael was manipulative and overpowering when it came to getting what he wanted.

“I just wish I’d shaken some sense into him and saved his life, because he had so much to offer.”
According to Pfeiffer, this voicemail is one of many “out of it” calls the drugged up Beat It singer made weeks before his demise, in which he shopped for drugs and begged for treatment — even though Murray was in charge of him in his final months alive.

On one occasion, Jackson even pleaded with Klein’s assistant for Propofol — the powerful anesthetic which killed him– telling him: “I do it all the time to sleep.”

Pfeiffer was originally asked to be a defense witness in Dr. Conrad Murray’s involuntary manslaughter trial, but Los Angeles Superior Court Judge Michael Pastor ruled him out, finding what happened in Klein’s office was irrelevant.

But in the Jackson’s civil trial against AEG, however, such testimony is expected to be introduced, which could make Pfeiffer and his claims relevant to the case.

AEG’s lawyers plan to use Jackson’s drug use history in their defense, arguing it showed Jackson was responsible for his own death.

“By the end, it became like a fix for Michael; getting face fillers and botox surgery was an easy way of getting Demerol.”

Pfeiffer said he’s aware of instances where Jackson faked medical issues so that he could receive Demerol, a painkiller.

“Michael was an addict,” he said.

“He always asked Klein to give him four times the regular amount even if it was for squeezing a spot or putting botox into his skin. Michael felt he was immune to normal volumes and begged for extra quantities.

“Sometimes some of our patients were groggy after shots, but never like Michael.”
And Pfeiffer recounted how on June 14 — just 11 days before his death — Jackson begged him to procure Propofol, even though he was being treated by Dr. Murray.

“Around 7 p.m. Michael called me sounding harassed and flustered; he barely had time to say hello before he just asked for Propofol,” he said.

“He asked me if he knew anyone that could supply him with that.

“Michael said, ‘I do it all the time to sleep, and I wake up feeling refreshed. I have to be up for tomorrow.’

“When I said I couldn’t help, Michael just shut me down and slammed the phone down on me.

“His voice sounded slurred and tired; I thought he was exhausted due to his rehearsals. On reflection it must have been drugs and I guess Dr. Murray didn’t get him enough.”
Pfeiffer said he never saw Dr. Klein administer intravenous drugs to Jackson, nor did he ever give him Propofol. Indeed, Dr. Klein has long insisted he personally tried several times to prevent other doctors from administering Propofol to Jackson to aid his sleep.

And even though Dr. Murray was charged with looking after Jackson for $150,000 a month from May, Pfeiffer said he never saw the cardiologist by his side.

“Dr. Murray never came along on any of his trips to Klein’s clinic,” said Pfeiffer, who previously claimed he and Jackson had a gay love affair.

“He obviously wasn’t looking after him 24 hours a day, seven days a week and Michael never mentioned him.

“I spoke to him once when he rang to make an appointment for Michael.

“At first I thought he was a joke caller, but then Michael grabbed the phone, and said: ’Hey Jason this is Michael that was Dr Conrad. I want to come in.’

“As for whether Dr. Klein should testify, we will have to see how the trial unfolds. Either side could call Klein, he would be a compelling witness who could have very valuable information.”

Would-be jurors in the Michael Jackson wrongful death case were asked to review the extensive list of witnesses who might be called to testify, and to let the court know if they recognize any of the names.

Selecting a panel in what’s expected to be a lengthy and potentially sensational trial has been a laborious and time-consuming process since scores of potential jurors were first brought to the downtown Los Angeles courtroom last week to see whether they had the time to even commit to a months-long case.

On Monday, a handful of about 100 possible jurors indicated they know one or more of the witnesses and were then dismissed from jury service.

The wrongful death suit was filed by Michael’s Jackson’s mother and three children who blame entertainment powerhouse AEG for the death of the pop singer. Katherine Jackson and her three grandchildren contend that AEG negligently hired and supervised Dr. Conrad Murray, who gave the singer a fatal dose of the anesthetic propofol on the eve of what was to be Jackson’s comeback tour.

The lawsuit alleges that AEG relentlessly pushed Jackson to move forward with the "This Is It" tour, knowing the singer was neither physically nor mentally capable of handing it.

AEG had advanced Jackson "substantial sums of money" and threatened that if it were forced to call off the tour "there would be lawsuits and Jackson’s career would be over.”

AEG, however, contends it was Jackson who insisted on bringing Murray aboard and that the entertainment giant had favored a British doctor instead.

The trial is expected to delve into the sensational – the singer’s eccentric lifestyle, his purported drug use, his enormous debt and his allegedly erratic behavior in the days leading up to his death.

Witnesses in the trial could include celebrities such as Prince, Diana Ross and Quincy Jones, as well as Jackson's ex-wives Lisa Marie Presley and Debbie Rowe.

Director Spike Lee and actor Lou Ferrigno are also among the listed witnesses, as are AEG founder Philip Anschutz and his former chief executive, Tim Leiweke.

Attorneys may add or withdraw names from their initial lists. Some witnesses will appear via deposition testimony.

Legal observers expect a salacious case that will examine the responsibility for hiring and supervising Dr. Conrad Murray to treat the late pop star.

AEG Live never got to take Michael Jackson out on one last final This is It tour, but a show will soon begin anyway in a Los Angeles courtroom.

The concert promoter is facing liability for its role in allegedly engaging Dr. Conrad Murray to treat Jackson. The doctor has already been found guilty of involuntary manslaughter for giving the singer Propofol before Jackson's death in June 2009.

Indeed, AEG demanded and required that Michael Jackson be treated by this particular doctor to ensure that [Jackson] would attend all rehearsals and shows on the tour. This week, the parties are in the midst of the intricate process of finding 12 jurors plus several alternates who can stay open-minded as they hear evidence and testimony on the death of one of the most famous individuals in the world.

AEG Live will be defending itself by saying there's no evidence to suggest that they were the ones to hire Murray. During discovery, the plaintiffs weren't able to obtain any firm contracts. The doctor was scheduled to be paid $150,000 a month to treat Jackson from an unsigned contract, but never saw that money and had been working with Jackson at the singer's behest for several years before the tour was even discussed. Thus, there's the unresolved issue of who actually was responsible for Murray's employment.

"He was chosen by Michael Jackson," said AEG's attorney Marvin Putnam on CNN's Michael Jackson: The Final Days, a documentary that aired earlier this month. "He was brought to Los Angeles by Michael Jackson. He had been Michael Jackson's longtime physician and continued in that capacity and was directed by him and could only be fired at will by him."

In contrast, the Jackson family will likely attempt to show that AEG's executives knew about Jackson's condition, made assurances to have Dr. Murray involved so that the singer would be ready for his tour, and put pressures on the physician that eventually led to the singer's death.

In one widely quoted e-mail, AEG Live co-CEO Paul Gongaware wrote to This Is It show director Kenny Ortega, “We want to remind [Murray] that it is AEG, not MJ, who is paying his salary. We want to remind him what is expected of him."
As Kevin Boyle, an attorney for the family put it at a hearing in February, "They had [Murray] in this situation where his loyalty became divided."

Although the essential question of the trial is narrow, it's hardly simple, and the proceedings are expected to cover quite a bit of Michael Jackson background -- enough to keep reporters enthralled for weeks.

AEG's legal team could spend some time discussing Jackson's drug abuse history and unsuccessful interventions by others in his family.

"This aspect of the case is obviously going to be very salacious," says Marc Nurik, an attorney at Liner Grode. "It goes to the control and supervision issue. If there's evidence that Jackson had been using this stuff before, it'll show he wasn't some unwilling neophyte to Murray's activities."

The family, in turn, might attempt to demonstrate for the jury a wrongful death in emotional terms. On its preliminary witness list are Jackson's children, Paris and Prince, his siblings, even his ex-wives Lisa Marie Presley and Debbie Rowe. Also tentatively (although not assuredly) scheduled to be on the witness stand are Diana Ross, Quincy Jones, Prince, Spike Lee and Lou Ferrigno. The family is seeking billions of dollars of lost income from Jackson's death and many of these individuals could talk about the stature of the late superstar.

Others who could appear as witnesses are AEG founder Philip Anschutz, former AEG Chief Executive Tim Leiweke and AEG Live president Kenny Phillips. If the latter gets on the stand, he'll be forced to explain his intimate familiarity with Jackson's troubles.

Three months before Jackson died, Phillips wrote to his company, "MJ is locked in his room drunk and despondent. I (am) trying to sober him up."

He added, "I screamed at him so loud the walls are shaking... He is an emotionally paralyzed mess riddled with self-loathing and doubt now that it is show time."

It is show time now. Just not the one he ever imagined.

Nurik imagines there might be reasons why AEG hasn't settled beyond that it feels as though it has a strong defense. He says, "I'm sure they don't want to be put in a position of conceding ground. They say [they] just paid for Murray, and at end of the day, they don't want to hold more responsibility when it comes to future promoting endeavors."

Judge: No More Excuses for Would-Be Michael Jackson Jurors

A number of potential jurors have handed over last-minute notes begging off the Katherine Jackson-AEG legal battle.

A Los Angeles judge says except for medical emergencies, she won't consider any more excuses from potential jurors in the lawsuit by Michael Jackson's mother against concert promoter AEG.

Superior Court Judge Yvette Palazuelos received a flurry of last-minute notes Tuesday from people asking to leave the case because of scheduling and financial hardships they had not claimed earlier.

She excused 10 more panelists from a pool of 87 and ordered attorneys to begin individual questioning.

One man declared he disliked Jackson and his whole family and thought Katherine Jackson's lawsuit blaming AEG for the singer's death is frivolous.
He was excused because his employer wouldn't pay for his jury service. Other prospects were less outspoken.

Jury selection in the case is scheduled to continue Wednesday.

Kim Kardashian knows this all too well, as Kris Humphries would currently be presumed to be the father of Kanye West's baby as it stands now.

As for who the biological father actually is, if it's not Michael? His longtime friend Dr. Arnold Klein has often been the subject of speculation there.

MJ's youngest son, Blanket, was born to an unknown surrogate. The star's biological paternity has been questioned in the youngster's case as well.

A Superior Court judge is poised to decide whether some records of Michael Jackson’s finances and medical history should be kept out of public view during a trial over the singer’s 2009 death.

Jury selection in the wrongful death case began April 2 and is likely to last at least another week, according to attorneys. But the fate of the confidential documents is expected to surface early next week.

The wrongful death suit, filed by Jackson’s mother and three children, accused entertainment powerhouse Anschutz Entertainment Group of hiring and controlling the Las Vegas physician who gave Jackson a fatal dose of the anesthetic propofol in the days before he was set to begin a series of comeback shows in London.

AEG contends that it was Jackson who brought Dr. Conrad Murray aboard, while the firm had planned to retain an English doctor.

Jackson’s estate, which is not a party to the wrongful death suit, is requesting that certain portions of the confidential records be shown only to the judge, witnesses, attorneys and the jury. If granted, the motion would keep some of the documents from being made public.

Attorneys for the estate also intend to look at the witness lists and depositions from experts to try to show which materials it wants to remain closely held.

Meanwhile, jury selection continued Friday and Kevin Boyle, one of the Jacksons’ attorneys, estimated that opening arguments would begin about April 29. The trial is expected to last four months.

Attorneys can remove as many potential jurors as they want if they can convince the judge they are biased. In addition, each side is allowed eight peremptory challenges, meaning they can remove a juror for almost any reason. Each side is allowed another five peremptory challenges for alternates. Twelve jurors and five alternates will be selected.

Another hearing next week will be held on AEG’s challenge to some of the Jacksons' expert witnesses, Boyle said.

Lawyers for Katherine Jackson have been nosing around ... trying to find out what Debbie Rowe might say under oath about the paternity of the two kids she bore while married to Michael Jackson.

Sources connected to Katherine tell TMZ ... her lawyers have been making a number of inquiries on the eve of the family's wrongful death trial against AEG Live.

We're told lawyers worry Debbie will testify Michael is NOT the biological father of Prince and Paris. TMZ broke the story back in 2009 ... Michael indeed is not the biological father.

Debbie is on the witness list for both Katherine and AEG Live. AEG has taken Debbie's deposition but -- shockingly -- we've learned AEG never asked Debbie a single question about paternity as it relates to MJ.

As for why Katherine's lawyers are so interested in Debbie's testimony ... she's the one who knows the most about MJ and the paternity, and they're worried AEG may try to prove the kids don't have any legal ties to Michael, which could torpedo their damage claim.

Katherine's lawyers have already filed legal docs asking the judge to exclude any evidence of paternity. The judge has yet to rule on the motion.

In the end, none of this may amount to anything because under California law ... when a woman gives birth while living with her husband, the husband is conclusively presumed to be the father, unless he's sterile or impotent.

LOS ANGELES (AP) - Lawyers in the wrongful death lawsuit brought by Michael Jackson's mother began using challenges to reject prospective jurors Friday but were confronted with a new set of panelists who had strong opinions critical of the superstar singer.

"Yes," said the man. "...That's my opinion, not the facts, based on what I heard." He said he learned most of what he knew about the case from the Internet.

"I don't think I could be impartial," he said.

Another prospective juror who is the son of a doctor said he had a strong bias against Jackson and thought that Dr. Conrad Murray was not at fault in the superstar's death. He said he knew that Murray had been convicted of involuntary manslaughter for giving Jackson an overdose of the anesthetic propofol.

"I don't believe Dr. Murray did anything wrong," said the man. "People take prescription drugs on their own. There may be some responsibility by Michael Jackson himself."

The man said he is also biased against people who seek large monetary awards in lawsuits involving doctors. He said his late father was an orthopedic surgeon and told him about the pitfalls of malpractice claims against physicians.

Mrs. Jackson's lawsuit claims AEG hired Dr. Conrad Murray as Jackson's physician without checking his credentials. Murray was later convicted of involuntary manslaughter in the death of the superstar.

Attorneys said outside court that the jury selection process could stretch through next week.
